This purchase agreement is six pages long. Please make sure you carefully read and fully understand each page. If you have any questions or do not fully agree with something in this contract please ask before signing as this is a legal and binding contract once the purchaser and Sauder's Kennel sign it. Firstly, all purchasers SHOULD FULLY REALIZE that there is no such thing as a 100% health guarantee for a living being such as a puppy. We strive very hard to try and raise healthy and happy puppies but as in life nothing is a 100% sure thing. Sometimes something unforeseen and beyond Sauder's Kennel control can crop up at any time in the puppies life. The breeder guarantees that your puppy was in good health at the time of vet examination and vaccination at the breeder's kennel, and has had all necessary initial shots and medications. Purchaser will have 72 hours or three business days to have the puppy examined by a vet of the purchaser's choice, at the purchaser's expense. A copy of this vet visit must be forwarded to Sauder’s Kennel either by email or by regular Canada post and must be received by Sauder’s Kennel within one week of purchase of the
puppy. If the puppy is found to be unhealthy with a life threatening hereditary defect by the purchaser's vet the breeder will replace the puppy with another puppy of equal value when available or refund the purchase price of the puppy when returned (to be discussed and agreed upon by all parties involved prior to making a decision)with the following conditions: it will be at the purchaser's expense and their responsibility for costs associated to return the puppy to the breeder's residence. The puppy must be returned to Sauder's Kennel by the purchaser within twenty four hours of the purchaser's vet visit. Breeder has the right to have the puppy rechecked by the breeder's vet before any agreement is made in reference to a replacement puppy or refund. Breeder's vet must agree with purchaser's vet's diagnosis in order for a replacement puppy or refund to be carried out.
ALL PAPERWORK SUPPLIED BY SAUDER’S KENNEL AT TIME OF PURCHASE PERTAINING TO THE PUPPY MUST ACCOMPANY THE RETURNED PUPPY.
All paperwork from purchaser's vet as to the puppy's supposed life-threatening condition must be supplied to the breeder within the twenty-four hours of examination and at the time when the pup is returned to the breeder so breeder's vet can view the purchaser's vet's findings and supposed life-threatening condition. If (and only if) the breeder's vet agrees
with the purchaser's vet report then and only with this vet agreement
the puppy will be replaced as soon as a puppy of equal value is
available or the purchase price refunded(must be discussed and agreed upon by all parties involved)within one month. Breeder has the right to have the pup re-examined by the breeder's vet before replacement puppy or refund of purchase price is agreed upon by the breeder. If breeder does not receive a vet report within one week after purchase of puppy then the breeder will assume puppy is in good health and purchaser will be responsible for future well being of puppy. In order for this puppy health guarantee to remain in effect purchaser must have their vet supply the puppy with all the necessary future vaccinations and at the proper times as suggested by purchaser's vet. Also the puppy must receive all necessary internal and external parasite treatments when suggested by purchaser's vet and any other needed and recommended treatments requested by the purchaser's vet. The puppy is eating TLC Whole Life Natural Dog Food which is purchased from the following link http://www.tlcpet.com/23173 and delivered to your door. The delivery to your door is free of charge. No more running out for dog food. Please make sure you order this at least one week before you are picking up your puppy. For this health guarantee to remain in effect you must carry on feeding this food. If you switch food the health guarantee will become null and void. This is a very good quality food for dogs and puppies and the breeder feels the puppy should stay on this. It is also one less stress for the puppy not to change the food. This food is fed for the puppy's entire life, no need to switch from a puppy food to an adult food.
IF ALL AND EVERY ONE OF THE ABOVE CONDITIONS are not met then this puppy health guarantee will become void and null. Also this health guarantee will become null and void if the puppy is allowed to become overweight and health problems arise because of this excessive weight problem and this contract will also become void if the puppy is bred at any time throughout it’s life. All Sauder’s Kennel puppies are sold on Canadian Kennel Club Non-Breeding Contracts with mandatory spay/neuter contracts and are sold for pets only not for breeding stock. If purchaser breeds the puppy either intentionally or unintentionally it will result in legal proceedings being initiated by Sauder's Kennel for breach of contract etc.
If a life threatening hereditary problem that severely limits the dogs day to day quality of life arises within three years of the puppy's birth the breeder will replace the puppy with a puppy of equal value when available or refund the original purchase price of the puppy(to be discussed and agreed upon by all parties involved)only if all conditions mentioned in the previous paragraphs have been met. All the purchaser's vet findings, x rays, all diagnosis and copy of all tests performed by the purchaser's vet must be forwarded to the breeder so the breeder can have their vet confirm or deny the diagnosis. No replacement puppy or refund will be honored by the breeder until this is completed. If the puppy dies from a life threatening hereditary problem that is a direct cause of the breeding of the parent dogs within three years of birth the breeder will replace the puppy with another puppy of equal value when available or refund the original purchase price of the puppy, only if all previous conditions in previous paragraphs have been met. In the event the puppy's death is the result of abuse or negligence on the part of the purchaser this guarantee WILL NOT apply and the breeder WILL NOT replace the puppy or refund any money. If the puppy has been bred and dies because of complications there will be no replacement puppy offered or any money refunded. If the death is from abuse or negligence on the part of the purchaser the breeder shall report the purchaser and their actions to the proper authorities and proceed with legal actions. Should the purchaser decide to have any NON-LIFE THREATENING defects of any kind repaired on the puppy at any time in the puppy or dog's life all costs for the surgery etc will be the full financial responsibility of the purchaser. There will be no warranty or reimbursement for allergies (either involving the family or the puppy) ears that do not prick up, entropian, ectropian, stenotic nares, cherry eye, undescended testicle(s), luxating patellas or that the puppy is show quality. Most of these are treatable and fairly easily corrected and are usually not life-threatening when treated quickly and properly. Breeder will not be responsible for any of these expenses. Any puppy refund will be paid to the purchaser within a three month time period from the date of agreement between the breeder and purchaser if a cash refund is decided upon. If a replacement puppy is decided upon then the puppy will be replaced when a puppy of equal value is available.
Should the purchaser decide at any time in the puppy or dog’s life to dispose of, give away or sell the puppy for any reason what so ever, the breeder must be notified and pup must be immediately returned to the breeder. Please do remember you are signing a legal and binding contract between yourself and Sauder’s Kennel and legal action may be taken by Sauder’s Kennel for breach of contract etc. Breeder will decide what is to happen with either keeping or placing the returned puppy. It is at the purchaser's expense to return the puppy to Sauder's Kennel. The puppy or dog must never under any circumstances be surrendered to any animal shelter, humane society or given or sold to a pet store at any time in it's life. NO MONEY OR REPLACEMENT PUPPY will be paid or given to the purchaser by the breeder for the returned puppy. The breeder believes that purchasing a puppy is a life long commitment and should not be entered into lightly or on the spur of the moment. The breeder assumes the purchaser has done extensive research about puppies and dogs and is aware of future costs for upkeep, food, vet cost, training, and that the purchaser is willing and financially able to supply these and also to supply the love, time, patience, training etc that the puppy will require for it's life. The breeder feels there should never be any need for the puppy to have to be surrendered, or disposed of at some future time in its life if the purchaser is a responsible pet owner. The breeder is available to answer questions and make suggestions and try to help if contacted. Please do not go behind my back and sell one of my pups as a lot of times I do find out and the consequences will be worse for the purchaser as this just leads to a total lack of trust. If the purchaser is having problems or need to place a puppy or dog then Sauder’s Kennel expects to be contacted immediately about this situation and expect the purchaser to live up to their end of this contract and return the puppy immediately. This health guarantee is non transferable to any new owner of the puppy(dog). This health guarantee is only valid for the original purchaser. Sauder's Kennel liability will be absolutely limited only up to the purchase price of the puppy in the case of a genetic illness diagnosis but there will be no refund for a returned puppy that the purchaser could simply no longer keep or did not want. Sauder's Kennel will not reimburse more than the original purchase price of the puppy under any circumstances.
Temperament: This puppy will be replaced with another puppy of equal value when available or original purchase price refunded(if agreed to by all involved)within one month , if it is proven by the purchaser or the purchaser and their trainer that this puppy's bad temperament is from bad breeding practices. Purchaser must provide breeder with written information to substantiate this claim. Purchaser must also show proof that the puppy and purchaser have attended every lesson from two full and complete sessions of puppy training being taught by a qualified instructor. The breeder feels that all puppies need to go to puppy school (irregardless of the breed) and it is in the purchaser's best interest and a good resource for future pet behavior. The breeder also has the right to have the puppy returned to the breeder at the purchaser's expense so the breeder can have behavior testing and vet assessment performed on the puppy before a replacement puppy or refund of original purchase price will be discussed with the purchaser. If every lesson of the two complete training sessions have not been completed and proof of this supplied to the breeder and also behavior assessment performed on the puppy then the puppy will not be replaced or any money refunded by the breeder. Breeder feels this is irresponsible behavior on the part of the purchaser.
Breeder guarantees your puppy to be in good health to the best of their knowledge and puppy shots are up to date for the age of the puppy(or have been explained to the purchaser if different). No guarantee is made on health problems or defects that cannot be detected by a veterinarian at the time of vet check. Problems such as diarrhea, coccidiosis, giardia, fleas, worms etc which can be cured with medication and little vet care are not covered in Sauder's Kennel health guarantee. Some of these problems can be caused simply by the stress felt by the puppy with moving to a new home, change in routine, change in water and exposure to other animals. Puppies are like children, they are susceptible to infections and common illnesses. All vet bills are the responsibility of the purchaser. Please call or email immediately if there are any problems or you have any questions or concerns. Once again the stress felt by the puppy from the introduction into a new home, change in food, or water supply can cause diarrhea. A remedy for common diarrhea is Kaopectate or Pepto Bismal. The dose is 1/2 cc per pound of body weight every one to three hours. This is a remedy used by a lot of breeders but is not intended to replace proper and professional vet care in any way.
IF ALL AND EVERY ONE of these above conditions have not been met by the purchaser the breeder will not be responsible to replace the puppy or to refund the purchase price of puppy. The puppy will not be replaced or any money refunded because or urinating or defecating in the house. The breeder feels it is up to the purchaser to properly house train the puppy once it has been purchased. A puppy is never 100% house trained at eight weeks of age. Also the puppy will not be replaced or any money refunded if the puppy cries when confined as the breeder feels the puppy should learn to be crated or confined for it's own well being and safety while the purchase is away or otherwise occupied and unable to supervise the puppy. All purchaser's need to realize that puppy's will cry when they leave their first home, mother and litter mates to go to their new home. Also they may cry when left alone or in the middle of the night. This is all part of puppy parent hood and should not be entered into lightly or on the spur of the moment. With love, time and much patience the purchaser will have a wonderful puppy that grows into a wonderful companion in the future, but it is entirely up to the purchaser to see that all these needs are fulfilled in full every day of the puppy's life and that they make the puppy into the wonderful dog it is capable of becoming.
Canadian Kennel Club registered puppies(CKC): the ckc papers will not be forwarded to the purchaser until a copy has been received by Sauder's Kennel that states the spay/neuter surgery has been performed. This must be completed on vet clinic letterhead paper, dated, and signed by the vet that performed the surgery. The report must also state the date the surgery was performed, name of puppy, breed of puppy, birth date, weight, color and sex of the puppy. A picture of the puppy must also be sent. When this has been forwarded and received by Sauder's Kennel then the registration papers will be forwarded to the purchaser as soon as available to Sauder's Kennel from the CKC. All purchasers will fill out a CKC Non Breeding Contract for their puppy while at the breeder's picking up their puppy. The non breeding contract means you are not legally allowed to breed the puppy at any time in it's life. It does not mean you can go behind my back and breed the dog and just not register the puppies. The pup must be spayed/neutered by six months of age. Sauder's Kennel reserves the right to choose the CKC registered names of all puppies produced at their kennel.
Violation of this agreement could result in court actions and legal proceedings being started by Sauder's Kennel against the purchaser and also the dog will be required to immediately be returned to Sauder's Kennel and also any offspring produced from this illegal action.
Absolutely no money will be refunded for the dog or any of the puppies that were produced.
It is the purchaser’s responsibility and will be at the purchaser’s expense to return the dog to the breeder. No refund will be given to the purchaser. The purchaser will sign the CKC registration papers transferring ownership back to the breeder and surrender the dog along with the ckc registration papers, microchip information, contract and any other paperwork supplied by Sauder’s Kennel at the time of puppy purchase and also any puppies produced if applicable. If the purchaser fails to return the dog and all paperwork IMMEDIATELY when requested legal actions may be undertaken for breach of this contract. The breeder reserves the right to immediately repossess the dog and all paperwork. The breeder reserves the right to pursue all legal actions available to them under the law including pursuit in court for the return of the dog to the breeder, compensatory damages, attorney fees and any court costs.
PLEASE REALIZE THIS IS A LEGAL BINDING CONTRACT, I CANNOT STATE THAT ENOUGH
I am not trying to be unfair but I am trying to raise healthy happy puppies that go to great and permanent homes with loving and caring people. I take placing my puppies very seriously and hope that the purchasers can respect this and are honest about living up to their obligation of the above conditions. If you are not willing to agree to this contract please do not fill it out and you should look elsewhere for a puppy instead of lying to me about your intentions.
BREEDER WILL NOT BE RESPONSIBLE FOR ANY VET BILLS OF THE PURCHASER UNLESS PREVIOUSLY ARRANGED AND AGREED TO BETWEEN THE PURCHASER AND THE BREEDER. THIS MUST BE IN WRITING WITH EACH PARTY RECEIVING AND SIGNING A COPY BEFORE ANY VET TREATMENTS ARE STARTED!!!!! BREEDER’S LIABILITY WILL BE
ABSOLUTELY LIMITED TO THE ORIGINAL PURCHASE PRICE OF THE PUPPY. BREEDER WILL UNDER NO CIRCUMSTANCES PAY MORE
THAN THE ORIGINAL PURCHASE PRICE OF PUPPY.
PUPPY PURCHASERS ARE REQUIRED TO CARRY ON WITH PET INSURANCE AFTER THE
SIX-WEEK FREE TRIAL PERIOD IN ORDER TO GUARANTEE THAT THE PUPPY/DOG WILL
RECEIVE ANY NEEDED MEDICAL ATTENTION/SURGERY ETC THAT THE PURCHASER MAY NOT BE
ABLE TO IMMEDIATELY AFFORD.
I, THE PURCHASER HAVE READ, UNDERSTAND, SIGNED, DATED AND DO FULLY AGREE TO ABIDE BY ALL THE CONDITIONS IN THE ABOVE PARAGRAPHS OF THIS PUPPY HEALTH GUARANTEE AS STATED ABOVE BY “SAUDER'S KENNEL".
